What is an Air Medical Service Organization?

An Air Medical Service Organization is an organization that furnishes, conducts, maintains, advertises, promotes, or otherwise engages in providing medical services with a rotorcraft air ambulance or fixed wing air ambulance with appropriately licensed and certified medical personnel. What is an EMSO?

EMSO is our acronym for Emergency Medical Service Organization. It is an organization that uses EMTs basic, EMTs-I, or paramedics, to provide medical care to victims of illness or injury. An emergency medical service organization may include, but is not limited to, a commercial ambulance service organization, a hospital, and a funeral home. (O.R.C. 4766.01(H))

What is a NEMSO?

NEMSO is our acronym for Nonemergency Medical Service Organization. It is a person or organization that does both of the following:

  • Provides services to the public on a regular basis to transport individuals who require the use of a wheelchair or are confined to a wheelchair to receive health care services at health care facilities or health care practitioners' offices in nonemergency circumstances; AND
  • (b) Provides the services for a fee, regardless of whether the fee is paid by the person being transported, a third party payer, or any other person or government entity. (O.R.C. 4766.01(P))

    Who needs to be licensed?

    Unless otherwise provided in this chapter, any person who furnishes, operates, conducts, maintains, advertises, engages in, or proposes or professes to engage in the business or service of transporting people who are seriously ill, injured, or otherwise incapacitated or who require the use of a wheelchair or are confined to a wheelchair. (O.R.C. 4766.04(A))

    How do I get a license?

    You submit a completed application, on a form provided, for the level of service that you will provide (basic life support, intermediate life support, advanced life support, mobile intensive care, air medical or ambulette) along with the appropriate fees to the Ohio Medical Transportation Board.     How do I get a copy of the form?

    You can request a copy of the form directly from our office by mail, Ohio Medical Transportation Board, 1952 West Broad Street. Columbus, OH 43223, or by calling our office at 1-866-392-6252.

    What if my application if not complete?

    The board cannot process incomplete applications. If we receive an incomplete application we will notify you via certified mail one time for each submission. When all required information is received the application process will continue. (O.A.C. 4766-2-01, 4766-3-01 and 4766-4-01)

    Do I need a license for each location I operate?

    If you operate or plan to operate an organization in more than one location under the same or different identities, you must apply for and meet all requirements for licensure or renewal of a license. You will not be required to pay a license or renewal fee for each separate location. You are only required to pay a single license fee. (O.R.C. 4766.04(G))

    What do I need for my vehicles?

    Unless otherwise provided by rule, each emergency medical service organization, nonemergency medical service organization, and air medical service organization licensed by the board shall have a valid permit for each ambulance, ambulette, air ambulance, and non-transport vehicle it owns or leases that is or will be used to perform the services permitted by the license.     What happens after the board receives my completed application?

    The application is reviewed for completeness and accuracy by our office staff. If it is complete it is sent to a field inspector. The field inspector will contact you and set an inspection date and place that is convenient for both of you. Your facilities and your vehicles must be inspected prior to commencing operations. (O.A.C. 4766-2-03, 4766-3-03, 4766-4-04, 4766-2-04, 4766-3-04 and 4766-4-04)

    What does the inspector look at?

    The inspector uses a check sheet for the inspection that is based on O.R.C. 4766, O.A.C. 4766-2, 4766-3 and 4766-4. The requirement can be found in these documents. A copy of the check sheet can be obtained on our website at http://omtb.ohio.gov or may be requested by contacting our office at 1952 West Broad Street, Columbus, OH 43223 or by phone at 1-866-392-6252.

    How long will it take to get my license and permits?

    It may take up to 60 days. Within sixty days after receiving a completed application for licensure the board shall approve or deny the application. The board shall deny an application if it determines that the applicant does not meet the requirements of this chapter or any rules adopted under it. The board shall send notice of the denial of an application by certified mail. The applicant may request a hearing within ten days after receipt of the notice. If the board receives a request within that period, it will hold a hearing in accordance with Chapter 119 of the Ohio Revised Code. (O.R.C. 4766.04(F))

    Is anyone exempt from licensing?

    Yes. There are many categories of exemptions. Please read O.R.C 4766-09 for a complete list of organizations exempt from licensing requirement. You can find the code on our web site at: http://omtb.ohio.gov.

    Are licenses and permits transferable?

    No. Licenses and permits are not transferable. (O.A.C. 4766-2-03, 4766-2-04, 4766-3-03, 4766-3-04, 4766-4-03 and 4766.4.04)

    How often will I be inspected?

    You will receive an initial inspection and an inspection annually thereafter prior to renewal of your license. You will be notified and contacted in advance for these inspections. You are also subject to unannounced inspections as deemed necessary by the board. (O.A.C. 4766-2-03, 4766-2-04, 4766-3-03, 4766-3-04, 4766-4-03 and 4766.4.04)

    Do organizations actually get penalties assessed and what is the penalty for a violation?

    Yes. Organizations actually do receive penalties and the penalties are generally significant. The board may assess a penalty of up to $1500.00 per violation. (O.R.C. 4766.8)

    How do I upgrade the level of service I provide?

    Submit an application for change in certification on forms prescribed by the board and include the applicable service fee of $100.00. An upgrade in level of service will not affect the expiration date of your license and permits. (O.R.C. 4766-2-06 and 4766-4-06)

    How do I add a vehicle to my fleet?

    Vehicles are added by submitting the required information on the form prescribed by the board, along with the applicable fees, to the board offices at 1952 West Broad Street, Columbus, OH 43223. The form may be requested from the board office or downloaded from our web site: http://omtb.ohio.gov. Applicable fees for Ambulettes are a permit fee of $50.00 per vehicle and an inspection fee of $50.00 per vehicle. Applicable fees for all other vehicles are a permit fee of $100.00 per vehicle and an inspection fee of $100.00 per vehicle. Remember, you can not operate a newly acquired vehicle until it has been inspected and permitted by the board. (O.R.C. 4766.07)

    How do I delete a vehicle from my fleet?

    Vehicles are deleted by submitting the required information, on the form prescribed by the board, to the board offices at 1952 West Broad Street, Columbus, OH 43223. The form may be requested from the board office or downloaded from our web site: http://omtb.ohio.gov. Within ten days after a licensed ambulette, ambulance, MoICU, Aircraft or non-transport vehicle is permanently withdrawn from service return the permit decal from the right rear Window to the board office.     Can I use lights and siren on my vehicles?

    Yes. Ambulances and non-transport vehicles are considered public safety vehicles pursuant to division (E)(1) of section 4511.01 of the Revised Code. Ambulances responding to an emergency incident or to an emergency care facility may use emergency lights and audible warning devices pursuant to section 4511.24of the Revised Code. In addition, non-transport vehicles bringing personnel, equipment, or supplies to an incident scene or an emergency care facility may use emergency lights and audible warning devices pursuant to section 4511.24 of the Revised Code. (O.A.C. 4766-2-14 and 4766-4-14).  This does not apply to ambulettes and NEMSO.
